A power of attorney allows an individual to give someone else the power to act on the individual's behalf to manage financial or other property matters. In circumstances where an individual becomes disabled or incapacitated, and a power of attorney was not drafted prior to the incapacitation, a court may need to appoint a third party to oversee the individual or the individual's property, or both.
Conservatorships and Guardianships can involve both adults and minors. The conservator or guardian has a fiduciary responsibility to the incapacitated individual’s property and person.
